Introduction
Welcome to Brown Boy Travels Shop (“BBTS”). These Terms and Conditions outline the rules and regulations governing the use of our travel facilitation services. By accessing or using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must refrain from using our services.
1. Our Role as a Travel Facilitator
1.1 BBTS operates as a travel concierge service, providing expert advice and facilitating travel arrangements through our affiliate agency, Fora Travel, and other trusted third-party travel suppliers.
1.2 BBTS does not provide, own, or control any of the travel services or accommodations booked through us. Our role is strictly that of a facilitator connecting you with travel service providers.
2. Definitions
For the purposes of these Terms and Conditions:
- Client: Any individual or entity using BBTS’s facilitation services.
- Service: Advisory and facilitation services provided by BBTS, including hotel booking assistance and travel planning.
- Booking: Refers to tour bookings, cruise bookings, hotel bookings, and activity bookings made through BBTS.
- Booking Date: The date on which a service is confirmed with the relevant travel provider.
- Deposit: A payment of $299/£299/€299 required to initiate our services
3. Services
3.1 Hotel, Cruise, Tour, and Activity Booking Facilitation
- Description: Professional assistance in selecting and booking hotel accommodations, cruises, tours, and activities.
Terms:
- A non-refundable deposit of $299/£299/€299 is required to initiate our services.
- The deposit will be applied toward the final booking cost.
- All bookings are subject to the terms and conditions of the respective hotel, cruise, tour, or activity providers.
- Clients must review the specific policies of the respective travel provider prior to confirmation.
3.2 Travel Planning Services
- Description: Comprehensive travel planning advice and booking facilitation.
Terms:
- A non-refundable deposit of $299/£299/€299 is required to initiate our services.
- The deposit will be applied toward the final cost of services.
- Planning fees will be detailed in the proposed itinerary.
- All bookings are subject to the terms and conditions of the respective service providers.
- BBTS facilitates but is not responsible for any changes or cancellations made by travel providers.
- Planning fees are non-refundable if the holiday is cancelled by the client or the provider. However, BBTS will assist the client in securing alternatives within a reasonable time. The payment for the planning fee will be deducted from any refunds received from suppliers.
4. Cancellations and Refunds
4.1 General Terms
- The initial deposit is non-refundable if the client chooses not to proceed with the booking.
- Any cancellations of confirmed bookings will be governed by the cancellation policy of the respective hotel, cruise, tour, or activity provider.
4.2 Planning Fees
- Planning fees are non-refundable if the holiday is cancelled by the client or the provider.
- BBTS will assist the client in securing alternatives within a reasonable time.
- The payment for the planning fee will be deducted from any refunds received from suppliers.
5. Package Holidays and Protected Travel
Where products are sold as packages protected by ABTA, ATOL, or other regulatory bodies:
- Protections are provided by our trusted partners who act as the principal travel provider.
- The terms and conditions of these partners will apply to your booking.
- Financial protection is provided by the third-party supplier, not BBTS.
- Details of the specific protection applicable to your booking will be provided at the time of reservation.
6. Administrative Charges
- Flight booking changes: 20% administrative fee plus airline charges.
- Itinerary modifications after initial delivery: 20% of affected services.
- Requirement changes after initial consultation: 20% of affected services.
- Changes more than 15 days before departure: 20% fee plus price differences.
- Changes less than 15 days before departure: 30% fee if changes are possible.
7. Supplier Terms and Direct Contracts
7.1 When making a booking, you enter into a direct contract with the travel provider.
7.2 All reservations are subject to the provider’s terms and conditions.
7.3 Any complaints or disputes must be resolved directly with the travel provider. BBTS will assist in facilitating communication but is not responsible for resolution.
8. Travel Insurance
8.1 BBTS strongly recommends purchasing comprehensive travel, medical, or other relevant insurance to cover:
- Trip cancellations and interruptions
- Medical emergencies
- Lost or delayed baggage
- Other travel-related risks
8.2 It is the client’s sole responsibility to purchase appropriate travel insurance. BBTS is not liable for any costs that could have been covered by travel insurance.
9. Liability
9.1 BBTS is not liable for service delivery by travel providers.
9.2 We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
9.3 Clients agree to indemnify and hold harmless BBTS from any claims arising from their travel arrangements.
9.4 Our liability to you will not be excluded or limited in any way where it would be unlawful to do so under English law.
10. Force Majeure
10.1 Neither BBTS nor the travel providers shall be liable for circumstances beyond reasonable control.
10.2 Provider policies will apply for cancellations due to force majeure events.
10.3 Administrative charges may apply for booking adjustments.
11. Dispute Resolution
11.1 Initial Resolution
- Contact BBTS directly for an amicable resolution. Complaints will be addressed within 14 days of receipt.
11.2 Legal Proceedings
- Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Amendments
BBTS reserves the right to amend these Terms and Conditions at any time. Changes will be communicated to clients and posted on our website.
13. Communication and Privacy
BBTS processes client data per applicable laws, including the UK GDPR and the Data Protection Act 2018.
14. Confidentiality
14.1 BBTS maintains strict confidentiality regarding client travel plans and personal data.
14.2 Disclosure of any client information will only be made as required by law or with explicit client consent.
15. Client Obligations
15.1 Clients must provide accurate and complete information during the booking and planning process.
15.2 Clients are responsible for reviewing travel documents and ensuring their accuracy before departure.
15.3 Clients must communicate any changes to their travel requirements promptly.
16. Special Requests
16.1 BBTS will relay any special requests to travel providers, but fulfillment of such requests is not guaranteed.
16.2 Special requests may be subject to additional charges.
17. Passport, Visa, and Immigration Requirements
17.1 Clients are responsible for ensuring that they meet all passport, visa, and immigration requirements.
17.2 BBTS will provide general guidance but is not liable for any issues related to travel documentation.
18. Health and Safety
18.1 Clients must ensure they are medically fit to travel and meet any health requirements of their destination.
18.2 BBTS will not be liable for any health issues arising during travel.
19. Compliance with Laws
19.1 Clients must comply with the laws and regulations of their travel destinations.
19.2 BBTS will not be liable for any consequences arising from client non-compliance.
20. Entire Agreement
20.1 These Terms and Conditions constitute the entire agreement between BBTS and the client.
20.2 Any amendments must be agreed upon in writing.
21. Payment Terms
21.1 General Payment Conditions
- Payments must be made in USD, GBP, or EUR.
- Credit card payments may incur a 3% processing fee.
- Prices exclude VAT or other applicable taxes.
21.2 Payment Schedule
- Non-refundable deposit of $299/£299/€299 required upon engagement.
- Full payment for hotel bookings, cruise bookings, tour bookings, and activity bookings is due at confirmation.
- Comprehensive travel planning payment schedules will be detailed in the service agreement.

23. Governing Law and Jurisdiction
These Terms and Conditions are governed by English law. The courts of England and Wales have exclusive jurisdiction.
- Consultation Fee Application – The consultation fee is non-refundable but will be credited in full toward the final trip cost if a booking is made.
- Non-Refundable Policy – The consultation fee is strictly non-refundable, regardless of whether the client proceeds with a booking.
- No-Show & Late Cancellation – If the client fails to attend the consultation or cancels/reschedules with less than 24 hours’ notice, the consultation fee will be forfeited.
- Rescheduling – Clients may reschedule their consultation appointment up to three (3) times. Any further changes may require a new consultation fee.
